Resumo: Em detida análise do arcabouço jurídico-penal pátrio, vislumbra-se a reprodução acrítica de teorias dogmáticas hermeticamente construídas sob o escopo de apresentar respostas ao seguinte questionamento: por que punir?. A partir de então, tem-se a constatação da importação de teses anacrônicas erigidas majoritariamente no contexto europeu, que não guardam mínima relação com o cenário fático latino-americano, e que, portanto, padecem de fulcral obsolescência ao tentarem justificar os fins da pena aplicada pelo judiciário brasileiro. Ao cabo, constata-se que a reprodução de discursos legitimadores do sistema punitivo encontra respaldo na clemência social por justiçamentos, e redunda no recrudescimento do aparato penal, que por sua vez, conduz à violação generalizada de direitos fundamentais constatada no sistema prisional brasileiro, que para além de restringir a liberdade do apenado, lhe relega à condição de não humano. Nesse diapasão, à luz da Criminologia Crítica e dos desdobramentos dela advindos, impõe-se a busca pelo exercício do Direito Penal enquanto dique de contenção da torrente do poder punitivo, notadamente a partir da evidenciação das contradições inerentes ao sonambulismo jurídico brasileiro, o qual persiste em legitimar a sanha punitivista fundada na apresentação do enclausuramento prisional como a solução ideal à neutralização dos indivíduos marginalizados, quando estes incorrem em condutas desviantes e são filtrados pelos critérios de seletividade penal, essencialmente dotados de preconcepções estereotipadas. Dessa forma, a presente monografia pretende se debruçar criticamente sobre as teorias tradicionais de justificação da pena, para, em sequência, responder à questão: Considerando-se as contradições inerentes ao discurso jurídico-penal no contexto pátrio, norteado por um sonambulismo jurídico que persiste na fundamentação calcada em discursos de justificação da pena, é possível delinear, à luz da criminologia crítica, uma desconstrução das teorias legitimantes das práticas punitivas de persecução do inimigo? Para realizar a atividade, adota-se como referência o pensamento da Criminologia Crítica, especialmente os trabalhos desenvolvidos por Juarez Cirino dos Santos.
Resumo em outra língua: In a thorough analysis of the homeland criminal-legal structure, it is seen the non-critic reproduction of dogmatic theories completely built under the objective of presenting answers for the following question: why punishing? From then on, there is the verification of the import of the anticlockwise thesis raised mostly in the European context, that has little to do with the factual Latin-American scenario, that, however, suffers from an old-fashioned foundation when they try to justify the ends of the penalty applied by Brazilian judiciary. Finally, it is verified that the reproduction of legitimacy speeches of the punishing system finds support in social mercy for justice and redundant exacerbation in the criminal apparatus, for its part, it leads to a generalized violation of the fundamental rights presented in the Brazilian Prison System, that besides restricting the freedom of guilty people, relegate them to non-human condition. In the same line of reasoning, lightened by the Critical Criminology and its unfoldings, a search for the Criminal Right exercise is imposed while the spill pallet of the current punishing power, noticed from the evidence of inherent contradictions towards the Brazilian legal sleep-walking, which persists in legitimating the punishing grudge founded in the presentation of cloistered prison as an ideal solution for the neutralization of the marginalized individuals, when they are involved in outlaw conduct and are filtered by the criminal selectivity criteria, essentially gifted by stereotyped prejudice. This way, this monograph intends to develop a deep and critical study about the traditional theories of penalty justification and then answer the question: Considering the inherent contradictions of the legal-criminal speech in a homeland context, guided by a sleep-walking legal behavior that persists in a compressed foundation in penalty justified speech, is it possible to spot by the light of the critical criminology, a deconstruction of the legitimately theories of the punishing practices of persecution by the enemy? To have this activity accomplished, a thought of Critical Criminology is adopted as reference, especially the work developed by Juarez Cirino dos Santos.
