| Abstract: | O presente estudo aborda questões acerca da efetividade do Termo de Consentimento Livre e Esclarecido em limitar a responsabilidade civil médica. A própria necessidade de um contrato escrito entre paciente e médico, a forma e os procedimentos a serem seguidos, bem como os princípios biojurídicos envolvidos em tal procedimento serão abordados buscando comprovar a relevância de se ter um documento que descreva as obrigações de cada uma das partes, protegendo-as e permitindo que se garanta a autonomia privada de cada um dos envolvidos. Será necessário, ainda, enquadrar a relação médico-paciente no universo dos Contratos, categorizando a relação ali estabelecida para demonstrar até onde o profissional se obriga. |
| metadata.dc.description.abstracten: | This study addresses questions about the effectiveness of the Informed Consent Term in limiting civil medical liability. The importance of a written contract between patient and physician, the form and procedures to be followed, as well as the bio-legal principles involved in such procedure will be studied, seeking to prove the relevance of having a document that describes the obligations of each of the parties, protecting them and allowing to guarantee the private autonomy of each one of those involved. It will also be necessary to frame the doctor-patient relationship in the universe of Contracts, categorizing the relationship established there to demonstrate the extent to which the professional is bound. |
